This ought to make for an interesting double appointment (chief justice and associate justice). I assume Scalia will be elevated.

What if Kerry had won? Then girls would be marrying girls and our nation would eventually turn from a paradise into one with the highest prison population...

You're probably right on Scalia. Thomas is a bit too much of a political liability to make Chief.

I would like to ask if anyone noticed if ABC interrupted programming Saturday evening to broadcast an obituary for Chief Justice Rehnquist, as they did when Peter Jennings passed away? I saw a fine Rehnquist obituary on Nightline tonight (Sunday evening). I just wonder if the big wheels at ABC saw the death of the Chief Justice as equally newsworthy as the death of their former Evening News anchor.
