Hi all... recently got selected for a paid tickling and foot fetish/shoe shoot w/ a Photographer/Producer in Cali. Worked with him several years ago, was VERY laid back and fun, however being selected again, I received an updated email from him saying this:

"Hi models, look forward to working w/ you all. In an effort to keep the competition, media and all other Photographers from getting tips from my shoots, please see the NEW rules below:
1. Live blogging, camera phones and/or video recording equipment is NOT permitted at any time. You will NOT use social media and/or take photos of this shoot at any time. All electronics are to be turned off. Taking photos without permission will subject you to copyright law violations.
2. You will be required to sign a "non-disclosure" form. You will NOT share any details of this shoot with ANYONE at any time.
3. You will be required to sign a 12 month no-compete clause. NO shooting with anyone else. Details will be on the contract.
4. You may NOT bring ANY photographer, producer with you to this shoot.
5. You must have NO modeling experience and be on NO other portfolios.
6. You may bring someone with you but NO camera phones, electronics, social media, etc will be permitted at anytime.
7. You are NOT to use ANY photos for your personal collection. If anyone wants to see photos from the shoot you MUST direct them to my sites ONLY.

So I wanted to ask everyone who is a Producer or even not a Producer... what do all these rules really mean? Having a hard time figuring out why some of these are rules? 12 month no compete clause? No photographer friends at the shoot? wth?

I'm not a producer, but as an attorney I can tell you that #3 is unenforceable as drafted since it's way too broad. Even if that producer was dumb enough to actually waste a few thousand dollars in court trying to enforce it (which he won't anyway), he would lose pretty quickly. It needs to be specific in the amount of time and the amount of area/location being covered. It also must be reasonable. I don't know if the courts would find 12 months reasonable, but since that seems to cover the entire planet as far as location goes, it's a failure.

The rest is basically saying to not take your own pictures there or distribute the pictures taken there. It's intellectual property and it's within his right. It's not a big deal anyway unless you were looking to steal his photos or take your own pictures while there.

I'm not a producer but that contract seems a little extreme, especially #3. Why wouldn't you be allowed to shoot with another producer for a year? Probably just wants to make his website original by having models that aren't seen anywhere else but I think it's unfair to isolate your models from other producers that they may want to work with. Seriously I'd think twice before working with this guy.
 
2, 3 and 5 are red flags. They mean don't even think of working with this clown.

This sounds fishy/creepy/truly BIZARRE.

Who cares if you shoot a video with someone else, it's not like he's Paramount Pictures hiring Tom Cruise for a three picture deal or something.....and if you compared the two, it still wouldn't
apply - foot models and tickle models make so little money, any kind of "exclusive" clauses are rendered utterly meaningless. (Besides, actors who DO sign multi-picture contracts usually
STILL do smaller films, or sometimes bigger ones if they can fit it in their schedule, on the side.)

The average minimum wage worker makes about $18,000 to $20,000 a year, so if you got paid that much in a year, you'd only be making about minimum wage!

The secrecy is CERTAINLY a massive red flag - models have wrote articles about tickle shoots before, and are free to describe the behind the scenes going ons......they never do, because
most people don't care, but they're still free to talk about it.

If he's "laid back," I'd be curious why the 180 degree change.....
 
Can you tell us the name of the "producer" so we can publicly shame him? Is he on this forum? Does he have a website with more than three poorly-filmed clips? He sounds like a fat, lonely, jealous pervert, especially #3. He probably doesn't want to imagine you being tickle-tortured by another producer, which is all the more reason you should not only turn this clown down, but be sure to send him links to your videos you film with other more legitimate producers.
 
Okay for #3 does this producer plan to hire you as an exclusive model and offer you continuous work? That would be the only way I'd work with just one producer only for a whole year. I would want it to be like a part time job.
Now #5 is what makes this sound like a bad idea, but in my years of fetish modeling I have run into producers that only want new/unknown/armature models or models that haven't been on a ton of other sites yet.
As for #7 I have yet to run into someone that has never allowed me to upload pics as long as I gave them credit. Me posting the pics gives the producer/photographer more publicity.
 
I have in the past have done this kind of work as a photographer and his non disclosure agreement is completely ridiculous. It sounds like some kind of weird trap. Tell him to pound sand.. No true producer with good intentions would make some of those clauses if all they truly were interested in was producing good media content.
 
I totally get everybody's feelings about this because there are so many questionable creeps out there. But maybe the dude just wants exclusive amateur models and he wants to make sure that his work can only be seen on his site? I don't think this is the best way to do that, and it's kind of pointless, since if it's worthwhile pics/video or not they will end up pirated. I do agree that #3 sounds "off"... but he does say that there are further details in the contract so we don't know the whole story. Since it's a "no-compete clause", he may just want you to agree not to work with any other foot/tickling producers. See if you can communicate with any models that he's worked with since his "new rules" and see what's up.

Oh, really? And he's going to be sufficiently generous to pay her a comfortable living wage every week for the duration of the contract whether she's shooting for him or not in order to make up for all other the work opportunities he insists that she turn down?

I doubt it and never meant to imply that he would. I'm just offering an alternative to everyone's knee-jerk reaction that he is trying to prohibit her from working for a year. Maybe he doesn't care if she does bikini/lingerie/nude modeling? Maybe he's going to guarantee her x number of shoots with himself over the course of that year? And I have no idea how this would affect the OP's income because I have no idea how many foot/tickling shoots she's offered over a year's time. I do hope that the OP keeps us informed as she gets any new info.
 
You were definately right to be nevous, trust your gut on this one.
I agree with the majority, especially on #3 and #5. Why can't you work for anybody else? Seems as though he may be afraid of other producers using the same model. If he puts out a quality product it should not matter. Also, if you worked for him before you would not qualify for number 5.
If you really need the work, ask questions for the reasoning behind the few rules that seem excessive. If you don't like his answers then it is probably best to stay away; again always trust your gut instinct.

Hey everyone... HUGE thanks for all of your guys' responses to this. Here's an update:

First, like I said in my OP, he was very laid back, professional, fun and strictly business. I never felt worried, anxious or anything. He's been doing this for a little over 7 years. For a 8 hour day shoot, I am roughly paid a $1,000. So he finally emailed me back and I asked him the same questions as above almost. He gave me the following answers:

"Rest assured I would never put you or any other model in any kind of danger. I have your best interests at heart. This is strictly to block off any other Producer's from working with my top models. If any other tickling producer contacts you about work, please refer them to me so I can give them my personal attention. Eventually I am going to start buying their content and paying for them to go away. In the meantime, please respect the terms of your contract (if you agree to it) by not working with ANY other producer in terms of tickling or foot modeling in the Southern California area. You may do general modeling, acting and other fetish based assignments however prior approval may be needed. Keep in mind you haven't signed a contract yet so you are not obligated to follow these however choosing to work w/ me on a contracted basis will subject you to these terms. Thank you."

So... I went ahead and also contacted (from his MM page) a few recent models he has worked with. Both said he was very professional, easy to work with and no issues.

I am honestly shocked now... STILL not sure of the other demands he has made. Oh well. He avoided answering them so... blah. Might just not do it. Didn;t know this industry was so competitive.

If you need the money, and don't intend on shooting another video, by all means, take it - $1000 is pretty nice for 8 hours of work.

BRING AN ESCORT - this is where you can really decide if he's up to something, if he says "No."

If you want to have FREEDOM and shoot with multiple folks, or make your own money and create your OWN videos, then obviously this guy isn't the way
to go.

Look at it this way - you'll get $1,000 from him, but you won't be doing that all the time.

If you shoot with two, three, four producers, you can make MORE than this guy will pay you when it all adds up. If you worked your butt off and shot a bunch of videos, or
created your own, you could make several thousand dollars in a year.

The part about him "paying competing producers attention" was...bizarre. I think this is a "nice" guy, who has an ego, and thinks he will "make it big" and put
everyone else out of business because he's so awesome. (Has he even DONE anything? I think like, before you even shot your first video, James Darke, Tommy and Turtleboy all finished about
three videos each.....yeah, that guy needs to get his show on the road!....)

....but the other racers can't even hear, they're already four miles down the road......

Wow so your new post makes it sound like he'll become your agent, but a bad one because he won't be helping you find jobs yet you'll have to run everything you do modeling wise by him. I couldn't work with a producer/photographer who wants to act like he owns me. I'd much rather freelance. 1,000 dollars for just 8 hours sounds great, but it really isn't if he is only going to hire you this one time and then you can't model for other foot or tickle fetish producers to make more money. Plus the whole you need prior approval for other modeling gigs leaves a bad taste in my mouth. Unless he is going to make you an exclusive model and hire you at least once a month with a 1,000 dollar pay(I am assuming modeling isn't your main job) I say get out now while you still can.

Christy, I work in HR and I can tell you that the non-compete clause is all bark and no-bite. I don't know about CA but nearly all states have some degree of a Right to Work clause so you really can't keep another person from working once they've left your employ.

I think in that business there's plenty of people that get taken advantage of. Producers, even "established" ones, still manipulate and many models are probably too uninformed to know better.

I say, if you have any concerns - don't move forward.

thanks again guys.. this is why I am so confused. Last time we worked several years ago everything went smooth and no "contract rules" like this ever came up. Just shot & that was it, didn't hear from him again. I finally got back in touch w/ him, expressed interest in another possible shoot and then it's been all over the place. I don't know what happened between now and then. At the end of the day I won't worry about it. I was only stressing because the money was good but don't think it's worth the hassle over being stuck in a contract. thanks all.
 
Yes! my thoughts exactly as well. If he wants to guarantee me 1 or 2 shoots per week then ok. if not then no

O.K., this statement creeps me out. If someone else contacts you he wants to give them his personal attention? That kinda has a stalker like vibe to it. And he's gonna start paying his competition to go away. What kind of business plan is that? The $1,000 would be nice as long as you don't plan on working with anyone else in the next year but something just doesn't sound right about this guy. I wouldn't do it but if you do like mabus said BRING AN ESCORT.

I would never expect any model to work for me, exclusively. I'm tickling you, not sharing company secrets. Also, the non-compete clause, as it is worded in the message you got is way to broad to be enforceable.
