Hello, new here but long time lurker of the forum. Im thinking of starting up my own tickle production company very soon. I have a couple of questions on legality, payments..etc. -

  1. Do you need to obtain a licence / permit to start the company?
  2. Ive seen videos where guys are very sexual in the videos and im very, how is that legal if the model is getting paid for the gig?
  3. Also how much do the models generally get paid for the hour?

1. Depends most of the professional companies are LLCs. Even Kink.com is just an LLC. Then you have the guy with cameras who just shoot mostly for their enjoyment and usually never bother with making it an actual company.

2. It depends what your state or city/county laws are. There are some states/cities that consider producers having sex with the model to be prostitution even if there is a camera put in front of it(You have to hire two models.). When you say very sexual are you talking about straight up boy girl porn or is very sexual to you groping and forced orgasms via a vibrator? Also keep in mind that if you're wanting to shoot porn you'll have to be tested before every shoot and you will want the models you're working with to do the same.

3. I don't really know porn rates because I know they tend to get paid per scene versus per hour. Straight up fetish ranges anywhere from 75-100 an hour maybe even more if you're hiring someone who's really well known and famous. The average rate nowadays for most fetish is 100 an hour.

I meant in general really. What are the limits for California. - and to go off of what you said i mean groping / orgasms any genital touching. That seems illegal to me, truthfully I dont know but the last thing i want is legal trouble for releasing a video. Wouldnt be worth the risk, and there isnt much I can find on tickling / limits in general online.
 
1. The models need to sign release forms, and I think there's a separate form to sell the material (I make videos but don't distribute them for profit, so I've never looked into it). I'm not sure about that one but a release is standard.

2. Pornography is legal, so you're good.

3. Depends on the location. In the South where I am, I am able to work with like $50 an hour/roughly $150 a shoot, in larger cities I've seen people admit to shelling out $200 and up an hour. It's really more what you think you'd be able to haggle, though in a larger city (presumably you're actually in San Diego) you're likely competing with several variations of fetish or risqué content production. Keep that in mind when trying to establish a base pay, but also remember that the "several hundred dollars per hour" a lot of people will tell you isn't exactly 'business standard', either.
 

More specifically an entertainment lawyer who has experience with the adult industry would be best. It's not overly complicated, but if you have specific questions, you want to speak to a specialist. You wouldn't ask a dermatologist about a neurology issue, so don't ask a divorce lawyer about adult content. ;)
 
Thank you all for your answers, and for everyone that PMed me, I thought about it and decided to not go through with it, its not worth the risk by any means and like people where saying the videos just going to be stolen anyway, not worth my time or hassle. Maybe you'll find it IS worth it, ....or maybe that information will encourage other people NOT to try it themselves.

...and maybe it's rival producers putting ridiculous false fears in you, to dissuade the possible future competition, be really careful for that one...

I mean, there are quite a few tickle producers out there, and they're just people like you doing the same thing...
 
Just my two cents but, I think you need to ask yourself what you're looking to get out of producing videos. If you're looking to make a lot of money, well, it's possible, but will require you to spend a lot of money. If you're doing it for fun, then it's really not that difficult, and can be a lot of fun.

LOL. Yeah, those other hundreds of clip stores are gonna be pooping themselves in fear over yet another GWC thinking he can make a buck.

News flash; nobody can compete with the top stores. They get the bulk of the business because people flat-out refuse to buy from anyone else no matter how good the product is. Everyone else is left scrabbling for the odd sale here and there. Trust me, TA & Co. don't have to waste their time lying to some n00b about the state of the industry. Anyone with a pair of eyes can see how shit it is just by lurking here for a month and reading the threads.
 
I'm a producer in San Diego. There is still some money to be made. Whether the top stores can be beat or not. You find our niche and you dig in. People like it they will buy. The handful of my old videos found on the hub are still bringing sales in.

If you have the drive and the spare time, go for it. It's not too difficult. What's difficult will be keeping up with the updates and posting edited clips for everyone on a consistent basis. Let me know if you have any specific questions.

Thanks! I actually have a ton of clips o need to edit and get uploaded. My apologies for not being as active with my store as I used to be. I do appreciate you all. But my mainstream photography career has become a larger priority and I need to find the balance. The spare time aspect of my last statement holds true. I simply do not have much spare time and I need to get back to it.
