I'll just cut to the point. I suffered a back and neck injury almost two years ago while at work. I've been on worker's comp and seen several doctors. Had several injections that helped my back. But herniated disks in my neck still hurt me. But the pain was minimal so I ignored it and enjoyed the time off. Specialist told me I wasn't a good candidate for surgery because the injections never gave immediate relief. Only weeks later.
Now I'm being pressed to settle the case or I could be sent to an.independent medical doctor who I fear despite the pain and burning in my neck. He may say I can work like this and send me back and ruin my case. My own inactivity caused this to go to long.
But I'm terrified now of settling my case and leaving the damage as is. Returning to work when I don't think I can all for a relatively small amount of money vs the risk of being told I'm okay.
I don't know what to do. Just accept the settlement and love with this. Or press the situation and try for another doctor and treatment when they think I've exhausted all options? Risking everything by dragging this out further?
I hope I can get some sound advice..
 
My first thought would be to retain a lawyer who can help you navigate the labor laws. This doesn't sound like something you should try and tackle by yourself.

Also explore if there are any additional options to relieve pain from your herniated disks in your neck.
 
Seek an attorney that specializes in personal injury. If money is an issue, seek help either from the legal aid society, ask the attorney if he does his cases on a contingency basis (which means if you win, you agree that he gets a certain percentage of what you get, which is usually 33 1/3%) or find one that will take on the case pro-bono (sometimes law students at a local college that are about to graduate will take on a case free of charge in order to get their name put in the paper for advertisement and to attract future clients). Definitely get an attorney, one that handle's workman's comp cases very regularly. They (and by they I mean everyone, your employer, workman's comp, and anybody else) will screw you HARD with absolutely no lube. You have to look out for yourself buddy. Because they absolutely will not.
