FCC Demands Immediate Investigation


NEW YORK -- The chief federal regulator of broadcasting was outraged by the Super Bowl halftime show in which singer Justin Timberlake tore off part of Janet Jackson's costume, exposing her breast.



Justin Timberlake said he did not intend to expose Janet Jackson's breast during the halftime show.


Timberlake blamed a "wardrobe malfunction," but Federal Communications Commission chief Michael Powell on Monday called it "a classless, crass and deplorable stunt."


MTV, which produced the show, and CBS, which broadcast it, both said they had no idea the halftime show Sunday night would include such a display.


"CBS deeply regrets the incident," spokeswoman LeslieAnne Wade said.


The two singers were performing a flirtatious duet to end the halftime show, with Timberlake singing, "Rock Your Body," and the lines he sang at the moment of truth were: "I'm gonna have you naked by the end of this song."


With that, Timberlake reached across Jackson's leather gladiator outfit and pulled off the covering to her right breast, which was partially obscured by a sun-shaped, metal nipple decoration.


The network quickly cut away, and did not mention the exposure on the air.


"I am outraged at what I saw during the halftime show of the Super Bowl," FCC Chairman Michael Powell said in a statement. "Like millions of Americans, my family and I gathered around the television for a celebration. Instead, that celebration was tainted by a classless, crass and deplorable stunt. Our nation's children, parents and citizens deserve better."


He instructed the commission to open an immediate investigation, promising it would be "thorough and swift." Earlier, FCC spokeswoman Suzanne Tetreault said it was launching a routine investigation because it had received complaints.


Messages left with Jackson's record company and her personal publicist were not returned Monday morning.


The FCC has come under fire from lawmakers and outside groups who say the agency hasn't done enough to shield the public from indecent programming on radio and TV.


Legislation has been introduced in Congress to increase by 10-fold the $27,500 maximum fine that the FCC can levy for indecency. The Bush administration has endorsed the bill raising the fine to $275,000. The agency itself has said it may start issuing the fine per incident rather than per program, and is talking about revoking licenses.


Last month, the FCC proposed a $755,000 fine against Clear Channel Communications for the "Bubba the Love Sponge" program that aired multiple times on four of its Florida radio stations. The fine was a record for a single complaint. The largest cumulative fine for indecency was $1.7 million paid by Infinity Broadcasting in 1995 for various violations by Howard Stern.


MTV, CBS' corporate cousin in Viacom, issued a contrite statement in which it also apologized, saying the display was "unrehearsed, unplanned, completely unintentional and was inconsistent with assurances we had about the content of the performance."


Timberlake said he did not intend to expose Jackson's breast.


"I am sorry that anyone was offended by the wardrobe malfunction during the halftime performance of the Super Bowl," Timberlake said in a statement. "It was not intentional and is regrettable."


Wade said CBS officials attended rehearsals of the show all week, and "there was no indication any such thing would happen. The moment did not conform to CBS' broadcast standards." The show also featured P. Diddy, Nelly and Kid Rock.


NFL commissioner Paul Tagliabue called the conduct "offensive, embarrassing to us and our fans, and inappropriate."


"We will change our policies, our people and our processes before the next Super Bowl to ensure that this entertainment is far more effectively dealt with," he said.


Over-the-air television channels cannot air "obscene" material at any time and cannot air "indecent" material between 6 a.m. and 10 p.m. The FCC defines obscene material as describing sexual conduct "in a patently offensive way" and lacking "serious literary, artistic, political or scientific value." Indecent material is not as offensive but still contains references to sex or excretions.


In an interview posted on MTV.com in the days before the show, Jackson's choreographer, Gil Duldulao, talked about the show, saying: "She's more stylized, she's more feminine, she's more a woman as she dances this time around. There are some shocking moments in there, too."

Welcome to the trash that's called entertainment today. The music scene has gone to hell since the dawn of the 90's and everything else in entertainment with it slowly but surely. Something like this doesnt shock me at all. MTV was once a great channel but then was taken over by kids non the less as the 80's came to an end. I'll remain in a time warp and stay in the 70's and 80's when the world and espessaly music was a much better thing.

Why is that the U.S. has such a problem with profanity, nudity, and sex, but violence is A-OK for everyday viewing? Wouldn't you rather your kids see a tit on TV than people shooting each other? I don't get how it's ok to show people beating each other senseless, but saying "fuck" isn't. If the Republicans want to truly decrease the size of government, they should start with the more ludicrous aspects of the FCC. Although I gotta admit... I didn't exactly want to see Janet Jackson's boob....
 
I know I was certainly shocked, appalled, and disgusted ... by that Cialis commercial that talked about "four-hour erections." Can I get the FCC to jump all over them too?

I totally agree with you dsk...I am stuck in the 70's and 80's too, there are a few exceptions to the bad entertainers today but they are exceptions rather then the rule. MTV has gone down the toilet. I wouldn't want my kids watching.
 
what i don't understand is why the FCC has a problem with a woman's boob being flashed but doesn't have a problem with for instance on the soap opera General Hospital (granted a much,much,much,much lower audience than the biggest football game of the year)...the mob boss shoots his pregnant wife in the head while she's giving birth and ABC airs it during the 3pm-4pm timeslot...that's what i don't get...yes i realize kids are watching the super bowl and all of that...but wouldn't watching the scene i described above be more disturbing to a child than seeing a woman's breast??? just asking
 
When was the last time anything other than softcore porn or excessive violence got this much attention in online forums and at the office watercooler? These messages are proof enough that the industry has found what works -- "the boob" is now more of a celebrity than the person it is attached to.

That still doesn't stop me from being irritated about what is on the television and airwaves, though. I wouldn't mind seeing writers actually use their heads to provide something entertaining. I haven't flipped on the television, lately, (except for the superbowl) because I got tired of the fact that the most popular show for awhile was about people eating bugs.

Speaking of that show...it's most famous star, Richard Hatch was naked again twenty minutes into it. Where's the outrage over that? 😀
 
It was the shock of it that got everyone all worked up- if American TV didn't have such strict regulations, no one would care (well- maybe a few people, but not like this) Also people obsess about the fact that they cut to commercial directly after it happened- people like to gossip, and the idea that something went wrong w/ something as big as the superbowl, and with as big of a star as janet jackson, gets everyone excited.

I don't watch the superbowl.

That being said, it had no effect in my house.

However, on another channel, there was a beer commercial and a girl was wearing a bikin that showed a lot more flesh than the pics I've seen from the halftime show.

I'd rather explain to my kid that she was wearing a little tiny silver bikini top, than try explaining something we see everyday on television, like a tampon commercial!

Can someone help me understand the logic behind "Boobs are bad" philosophy? I mean I just don't get it. Sex is natural, it can be risky so it probably shouldn't be endorsed to this modern day degree, but the human body is not risky. I mean what's the harm in seeing a boob? From a child's perspective even, most children are not really going to care much. What's the harm in teaching a child what the human body looks like? A boob does not promote sex, people do. Why do people seem to think that the human body is somehow 'wrong'? I find it quite beautiful.

A little boy might throw a big fit over seeing a boob, but that's only becaus he was taught that it was some how 'wrong' to see one, if he didn't think that it wouldn't really matter. Little boys always get a kick out of doing something when they think they are getting away with something 'bad'. It's not sexual, by any means. When I was in fourth grade I ran around school with my father's playboy once, it was fun as hell, but that was only because I was a fourth grader with something I wasn't supposed to have in a place I wasn't supposed to have it. Not that it had naked girls in it, I didn't really care about that...ok maybe a little, but that was only because I was curious to see what a girl looked like.
Sex and children is wrong. But nudity does not equal sex. I'm saying that you should not be afraid to teach your child what a woman and man look like. I'm not insisting you have too or that you should, but in my experience the people raising a fuss over this sorta of thing are the people afraid to let their children see a naked boob.
 
I wouldn't personally care if my child saw a hundred boobs... but, were I a parent, I would have been horrified had my child witnessed the aforementioned halftime spectacle. While I see nothing wrong with nudity, the manner in which this event transpired (a man ripping a woman's bodice apart while singing a sexually-charged song) is not something I would want my child to witness, as it portrays human sexual interaction in an inappropriate way- and a young child lacks the contextual knowledge to know this. It is a parent's right to decide how and when their child is exposed to sexual relations, and it was wrong of CBS, MTV, and the entertainers involved to perform a lewd act without warning in the middle of what would normally be thought of as family entertainment.

How can this country be SO obsessed with an exposed boob.

I don't know about the whole country, but I'm not obsessed with it. The media is obsessed with it. The judgement your making is that if the media makes a big deal out of it, the rest of the country does to.

I was finally able to download the Howard Dean 'rant' and the Superbowl breast.

Howard Dean - what did he really do wrong? He was a little goofy, But I was expecting him to be giving the camera the finger or something from all the blabbering that went on about it. It wern't nothin'.

The Super boobie. From watching it over & over again it relly does seem that it was an accident. From the reaction of the two - especially Janet, the framing of the shot, and I'd heard that John Lovitz was sitting in one of the VIP botths watching and when the event occurred the wardrobe woman went crazy whe the costume ripping didn't work right; just the entire concept of the thing doesn't read correctly, (plus watching that big breast flop ot was kind of gross, you think they would had structured the garment better & prettied up the whole thing if it was planned...) . It just strikes me a an accident. And there have been accidental body parts showing up on U.S. tv for some time.

Well, I don't do sports. But this weekend is my superbowl, The Accademy Awards. I wonder if that Whale Rider actress is gonna be pulling anything out.

I thought the incident was an "accident" but if it wasnt oh well, i mean they should breasts on tv all the time now adays as well as use language that shouldn't be used in case a child is watching that particular channel, i doubt anyone feels the way i do but i had to express my opinion
