The law varies from state to state. Some dungeons (such as Passive Arts in L.A.) are very careful to stay within the law and advertise themselves as legal. Others (such as The Hidden Chamber in NYC) had Mistresses who offered strap-on sessions and got busted. It should be noted that the Mistresses were arrested, not any clients.

As long as no direct sexual services are performed then yes, it is legal in most US states and countries. Tying and tickling someone is not sex and therefore not directly related to prostitution.
