The lawsuits between Borgier and Ross were proceeding along.
As difficult as things were for Ross., Borgier was having even more problems.
Borgier was an attorney, while Ross was not. The client who was suing Borgier that caused he whole mess in the first place, filed a complaint against Borgier with the Bar Association.
Upon looking at Borgier's whole situation, between the client that had sued Borgier, Borgier's vindictiveness against Ross, and Ross's lawsuits against Borgier, decided to suspend Borgier's law license
Borgier was livid, he could have kept suing Ross, but, between Borgier's legal fees for the lawsuits against Ross and the other lawsuits Borgier's clients filed, and Borger's company's reputation, such lawsuits were becoming very expensive for Borgier to fund.
Ross's attorneys offered Borgier a settlement. Sign papers, no money exchanged, plus pay all of Ross's legal fees and expenses for the lawsuit.
At first ., Borgier told Ross's lawyers to take the settlement and go to Hell. Yet, as the legal fees and problems for Borgier mounted, such brazen behavior was not prudent for Borgier.
One night, as the whole drama was unfolding, Ross and Kayley discussed the situation.
"Well, Kale, we could be almost out of this, or this could be a long drawn out battle. I personally don't see how Borgier could win any lawsuit, between his own conduct, and his initial suit against me. He could spend thousands of dollars , get nowhere, and end up having to settle with me anyway. The second issue is, Borgier's reputation with both his company, and as a lawyer, for going on with this, could take a major, major hit. By the time Borgier is through, he might well lose his company to the other guy who sued , me, and have his law license revoked. "
"It would serve the bastard right for all the trouble he's caused" Kayley said. ]
"I feel like telling my attorneys to draft another settlement stating that he has to pay me damages. If I do that, Borgier could tell everyone to go fuck themselves, and simply declare business and personal bankruptcy Borgier would be finished if that happens. Although he might be finished anyway depending on what happens with the lawsuits, and the legal license situation" Ross said.
"If his company goes bankrupt, the court takes over, right? " Kayley said.
"Yes. At that point, any creditors Borgier has could take Borgier and his company apart piece by piece, and just sell it for pennies on the dollar to pay everyone off Then there is the question of Borgier's situation with the tax department. Since the tax department comes first before anyone else, we would all wait in line for whatever is left" Ross said.
"Would you be able to get his company if that happens? Kayley said.
"I dont think I would want it. Too much conflict of interest with name and reputation. Taking over a company that was picked apart by creditors and the tax department, plus taking over a company that had been sued by me and my company. At that point the court would put the company into what is called receivership, where the company would just be auctioned off to any person or company who wants it, for a bargain price" Ross said.
Ross continued. "In all likelihood, worst case I pay legal fees and get nothing, Best case Borgier pays all of my legal fees" Ross said.
Borgier was in major, major trouble. It looked like he was going to lose everything. The question was. would there be a surprise development before the clock struck midnight for Borgier? That remained to be seen.
