Hey,

Are there many examples of tickling videos with the women in Disney costumes? Struggling to find any!

I know Scarlet Sinns did one as Elsa. And I think there was a Frozen themed one out of FTKL

Aunt Cass has a thing going on with the internet right now. Maybe they will do one with her soon.
But there’s only really a few videos. And they are listed above. There are some short CGI themed clips and LOTS of artwork. But videos? Maybe there might be if you can afford a custom one.

I actually just watched Sleeping Beauty last night. I would love to see Maleficent tickling Prince Philip. What I want to know is why they didn't cast ether Catherine-Zeta Jones or Monica Bellucci in Snow White & the Huntsmen. Both of them have a stronger likeness to the animated version.

Could copyright issues have something to do with it?

Simply put the words "Erotic Parody" in front of it. The only issue I see is that some characters are mijors. Like, for example, Aurora from Sleeping Beauty. My fantasy with
Maleficent tickling Prince Philip works because he's more then 2 years older then Aurora who's 16 when she pricks her finger.

Sure, but if you play it as just in the costume and not specify playing the character with their age, you're fine. The models will be of legal age and don't look like minors.

As I said the last time this came up, almost certainly yes. Disney has big expensive lawyers and they are both expensive and scary. Did I mention they're expensive? It doesn't matter whether you'd be legally in the right (you probably wouldn't), Disney could still drag you into court and eventually bankrupt you in legal fees and even if the court ruled in favor of you, congratulations! Now you're broke. Are your "fans" going to buy the video in enough volume to offset the court costs? Sources say no.

AFAIK that's not actually how parody laws work, so no. Don't do that.

That could be it but there's a decent amount of superhero cosplay videos. If copyright issues was the problem then wouldn't that also apply to superhero videos?

It certainly does, but here's the thing; lawyers can't prosecute everyone who's in violation of their copyrights simply because they don't have the manpower to do so, so people say "well X got away with it so it must be ok".

I always ask people if they want to be the one random guy that the Mouse decides to make an example of to discourage others from trying the same thing. Do you?

The other thing about cosplay is that cosplayers are usually pretty careful to indicate that they're not representing the character/company in question and they're also not (usually) doing anything to hurt the brand while in costume. Porn most certainly doesn't fall under that umbrella. And again, even if they did, Disney isn't going to prosecute Joey Random for wearing a Sonichu costume to LocalCon. They're going after the big-name cosplayer that's attracting sponsorships based on same. This is definitely where a video producer stands more chance of running afoul of the Mouse and its lawyers, because you're monetizing a copyrighted image in a way that's harmful and misleading to the original brand.

Marvel (owned by Disney) has indeed shut down a number of fan films about the Punisher. It seems they take it on a case-by-case basis a lot of the time, though.

It also doesn't even require an image; I had a calendar revoked for sale on Zazzle because I made reference - in text - to the band Spinal Tap, and the company that owns the trademark on Spinal Tap contacted them and told them to take it down. Was I legally in the clear? Probably. Did Zazzle care, and made me remove the reference in order to get reinstated? Why, yes. Yes they did.

Yes. Scarlet was The Queen of Hearts and she tickled the feet of Alice in Wonderland played by Krissy Koven. It was a good video.

Seriously fascinating read that, thank you! I know Disney have a rep for suing.

On Disney IPs, yes. But most Disney movies are based on public domain stories and legends. I feel like fair use could also play a part. But I’m no lawyer.

Fair use doesn't apply if you're copying Disney's interpretation of the character, which you most certainly are if you're using a Disney costume to represent them in your video.

If you simply douse your model in flour and have her tickled by seven midgets, no one is going to bat an eye if you call your video "Snow White and the Seven Dwarves". If you put her in that iconic black and yellow dress and have her sing "some day my tickler will come", hoo boy, you're going to court.

Yep. That’s right. At least a cease and desist. At least for a few more years. Or decades. Depending on the movie. Maybe.
