Basically I have my first ever switch tickle session set up in a hotel (somewhere in Philadelphia) with a domme who is visiting from out of state. I just don't know what is legal and what isn't. There will be no sexual contact other than tickling and some foot play. However, I have been told and read things ranging from "if it is BDSM" or "if the person gets sexual satisfaction" (which I would) it can be considered "paying for sex" which is illegal. I know I'm probably just paranoid, but I don't want the police knocking down the hotel door and having to explain to them or a judge that it wasn't for sex, it was for tickling lol. That would basically ruin my life since my fetish is kept very private. If anyone could help answer this I would greatly appreciate it. If there are any lawyers or police officers who read this and don't want to answer in public, just PM me. Thanks.

Every states laws vary, research Pennsylvania's statute on prostitution/solicitation. Google is your friend here, and a few minutes will answer your question. Hope that helps.

I think here is no clear "legal or illegal" rating here. Things like that can be up to the interpretation of the judge! So if the risk is too high for you, don't do it.

A lot of producers have filmed tickling videos in hotel rooms. I remember the only producer that got in trouble for it was Tickling Paradise because they were stupid enough to produce a non-consentual video and distribute it.

I can't imagine a cop or judge giving a shit about this. Most pros in my opinion are rip offs and it's not worth the risk.

Yeah, but the difference between porn being legal and prostitution not has always baffled me. So, it's only solicitation if there's no camera involved? Weird. Anyway, film your session and say you were making a video and you should be in the clear.*

1. First, the cops would have to be interested and motivated to catch you doing something.

2. Assuming 1 is true, they would have to have a reason (probable cause) to barge in on you.

3. Assuming 1 and 2 are true, either you are the dominatrix would have to be sporting private parts in order to be assumed as a sexual encounter.

4. Assuming 1, 2, and 3 are true, they'd have to observe you making a financial transaction to pin anything illegal on you.

Chances are you got nothing to worry about. But if you're still worried anyway, just keep your shorts on and keep her black leather teddy on, and you are good to go.

Tickling would be considered heavy petting... not sexual at all.

No worries!

If a someone presses charges they would have to lie for something to stick.

Enjoy your tickling!

Dandy Jack!

To ease your worries a bit, let's look at simple math... how many paid tickling sessions occurred in the world? Probably tens of thousands, if not more.... out of all those, how many got busted (that we know of)... 0? 1? With odds like this, you have nothing to worry about.

I don't believe it is illegal, as long as no money is being exchanged.

For example, a couple staying in a hotel room that decides to play .. they aren't doing anything illegal, just having fun and exploring their sexuality.

I'm fairly certain you'll be okay as far as the law goes.

Well first I'll be honest, I'm not a cop or a lawyer. But Pennsylvania state law defines prostitution as the exchange of money or goods for the purpose of engaging in sexual activity. And it defines sexual activity as intercourse, oral, handjobs or deviate sexual relations. So if you get sexual satisfaction from foot worship or tickling and you pay for her services that could be considered prostitution in the state of Pennsylvania. I'm not recommending that you do or don't go through with it. For something as innocent as tickling the cops may not even care but just remember if they decide to follow the law to the tee you could be in a little bit of trouble.

If you don't mind a little bit of a drive see if this same domme is having sessions in New Jersey or New York and meet her there instead.

Is something like this legal in NJ or NY Feather?

A couple years ago there was a domme in New York that got arrested for having paid foot worship sessions. The case went to court, AND SHE WON! The court decided that since no sex was involved in her sessions it couldn't be considered prostitution. So foot worship for pay is legal in New York. And if that's the case I'm guessing they wouldn't have a problem with tickle for pay either.

But as far as New Jersey goes I spoke too soon. I just checked their laws and it's the same as Pennsylvania. So Jersey is also go at your own risk.
