There's a big difference in what the government says and what it does or will do, or even what it can or will enforce. Just take a look at some of those books of crazy laws that are still "on the books" in a lot of states, like not being able to buy ice cream on Sundays.
On a more practical note, I offer the example of the HIPAA code that went into effect about 2 years ago. That regarded the use of private information in the context of health care and treatment. The privacy complexities of that code are enormous, and most places will pay lip service to it - they have to, since no one really wants their healthcare information just open to anyone. But, in practical terms, doctors and hospitals can't do business or do their job without sharing some information with other doctors, other staff, or insurance companies (damn them all to hell). And not once, since that policy went into effect, have I heard of violations being prosecuted and/or investigated, and (as I work in this field) not once has anyone from any level of government checked on us or made sure we were "HIPAA compliant". In short, nothing will happen under that code because it really is in no one's interest to make a huge deal out of it, unless there are flagrant abuses going on - in that case, you have a mandate to prosecute under that has it spelled out what is right and wrong (and even then, such a case, in court, would be subject to review).
So, while you may have to be careful, I sincerely doubt that anyone in the porn industry is practicing such that they are leaving themselves open to lawsuit, and in the tickle community (which is much smaller and not as easy to pin down as "sexual" or mature in nature or content), I think the likelihood is that all producers are protecting themselves well. The grounds, therefore, for any "infringement" of the law would have to be either extremely trivial or extremely pedantic.
But that's just my 2 cents. I say keep up your good work, but be as safe as you can (naturally). Just don't let the government frighten you into giving up what you want to do - that's just BS.
