Thanks for the info. I'm not sure whether this will go through unchallenged, because it would mean the virtual death for a million porn websites, if not the current form of the internet as a whole. The porn industry has a lot of financial clout, and large parts of the internet providers are financed by the demand for porn. Furthermore, this law will probably collide with the Freedom of Information Act as well as the constitution. I'd say let's wait and see.

I have to agree with Hal

There's a big difference in what the government says and what it does or will do, or even what it can or will enforce. Just take a look at some of those books of crazy laws that are still "on the books" in a lot of states, like not being able to buy ice cream on Sundays.

On a more practical note, I offer the example of the HIPAA code that went into effect about 2 years ago. That regarded the use of private information in the context of health care and treatment. The privacy complexities of that code are enormous, and most places will pay lip service to it - they have to, since no one really wants their healthcare information just open to anyone. But, in practical terms, doctors and hospitals can't do business or do their job without sharing some information with other doctors, other staff, or insurance companies (damn them all to hell). And not once, since that policy went into effect, have I heard of violations being prosecuted and/or investigated, and (as I work in this field) not once has anyone from any level of government checked on us or made sure we were "HIPAA compliant". In short, nothing will happen under that code because it really is in no one's interest to make a huge deal out of it, unless there are flagrant abuses going on - in that case, you have a mandate to prosecute under that has it spelled out what is right and wrong (and even then, such a case, in court, would be subject to review).

So, while you may have to be careful, I sincerely doubt that anyone in the porn industry is practicing such that they are leaving themselves open to lawsuit, and in the tickle community (which is much smaller and not as easy to pin down as "sexual" or mature in nature or content), I think the likelihood is that all producers are protecting themselves well. The grounds, therefore, for any "infringement" of the law would have to be either extremely trivial or extremely pedantic.

But that's just my 2 cents. I say keep up your good work, but be as safe as you can (naturally). Just don't let the government frighten you into giving up what you want to do - that's just BS.

I think devilscabanaboy makes a good point—except that this gang of Puritans has a special burr up its collective ass about all things sexual.

It would appear to me (not that I’m a legal expert) that the new regulations tickletelevision is talking about are intended specifically to harass people in the 'adult entertainment' business. Whereas the HIPAA regs that are now in effect are intended to make it *appear* that everyone’s medical info privacy is protected, while allowing the insurance industry to do whatever it damn well pleases.

This is the standard MO of this gang. They pander to the ignorant about the evils of the “homosexual agenda,” but allow a gay internet hooker into news conferences posing as a ‘reporter,’ so he has the national media stage from which to toss softball ‘questions’ to the ‘President.’

We live in a new America, friends. Tort reform means making the courts inaccessible to ordinary people with legitimate grievances against big business, and bankruptcy reform lets the rich escape their debts, but not ordinary folks who’ve been financially ruined by major medical catastrophes. “Forest protection” means clearcutting, the “Help America Vote” act means making it easier for the powers that be to rig the results, and the Clear Skies Act means relaxing virtually all regulations on polluting industries.

I hope tickletelevision is needlessly alarmed, but I’m afraid he’s right. We’re in trouble. And this isn’t even nearly the worst of it. Unfortunately, unless there are brown shirts and jackboots, we don’t seem to recognize fascism when we see it.​

Well spoken ticklevids.....especially since most of this is geared towards protecting minors...another reason why the forum mods here crack down hard on materials posted containing images of those whose age is questionable...

If anything the Government will go after every major porn producer long before they even think about forums such as this one and those producers will be able to tie any action up for years in the court system, so everyone step back and take a deep breath......exhale....

Well, Ray, although I agree about relaxing, I find your logic a bit faulty in one aspect: If I were a prosecutor, I'd pick a small niche producer with little or no financial clout to get a precedent case first. They always try to break a chain at it's weakest part...

But I agree that they wouldn't start on tickling. Probably a BDSM or bondage site, I guess. It's easier to impress a jury with something like pain, not something that looks relatively harmless like tickling.

We might or might not be covered under these two:
(D) sadistic or masochistic abuse; or
(E) lascivious exhibition of the genitals or pubic area of any person;

but in many if not most cases I would say probably not. Ive done some orgasm tickling, and thats probably lascivious exhibition, but I seriously doubt if anyone could argue that what we're doing is sadistic or masochistic abuse, in the context of floggings and whippings and so forth, which is the context at hand I believe.
