All models sign a model release before the shoot. Without that, it is illegal to sell or eben post the stuff online for free. I doubt any producer would take that risk.

Models usually ask for references when it comes to stuff like that. They might be a little suspicious when the person shooting with them never put a clip online before.

All models, whether they are professionals or the girl next door type trying something new, have to read and sign a consent form which states exactly what the video shot will be used for, among other things. There is no way any model would not know a video is going online, unless the producer is completely illegitimate, or they are just completely stupid.

Are you referring only to paid models, or are you referring to the situations where amateurs post videos on tmf and youtube or a clipstore?

Like, if I were to video record myself tickling my girlfriend and then sell it at a clipstore or post it on youtube, I probably could get away with it without her having any idea. Is that what you mean? I guess as long as nothing sexual or no nudity is involved you could probably get away with that posting it on youtube or something. In terms of a person specifically asking for you NOT to post a clip for other to see, a contract would DEFINITELY have to be drawn up first, otherwise he/she has nothing but their word against you if they try and take it to court.

What the hell do you think youtube is? If there's nothing sexually explicit in a video you can post it on a site like youtube. You think friends that post short vids of them tickling their other friends on youtube get sued. Get with it.

OOOh OOOh OOOOOh Let me add my perspective. I am under the impression if it is shot in public or a location where a person could reasonably be expected to be caught on video, or if it is posted in locations not for profit it is so fine a line the supreme court can't decide the same way twice. Plus the internet is very sticky in legal aspects still but a legitimate producer would never risk working without a release all the same.

LOL, like a girlfriend is gonna sue her boyfriend for posting a clip of him tickling her foot onto the internet. What is her case seeing as how there is nothing sexually explicit about it as long as they're fully dressed. I'm sure a lot of the people that have clips showing them on youtube don't even know that there is a clip out there with them in it.

Dude. That woman sued McDonald's for her coffee being hot. There will always be someone out there to sue someone over any little thing, and even in the best of circumstances, what you are stating is still questionable. Disregarding intent, it's how it's used. Maybe, for the sake of a class, a friend records me sneezing, so as to analyze something medical that I don't understand. Friend puts this on youtube for the sake of his class, and it gets a bunch of really raunchy comments talking about how they want to do nasty things to me. Yeah, I'd want it taken down, and if my friend didn't, I'd be beyond irate.

If you make a profit out of it for, by example, a video that you shoot and told the model that is was for your private use, and later on the model finds it on a clip4sale store, she/he can easily menace you with going to the law. With professionals you must let them know by contract. That is crystal clear.

As for private videos of people you may know in public/private areas, is still a grey area because the technology, has change very fast. The potential for abuse and cruelty is enormous, since after a image/video is release it would be virtually impossible to take it out of the cyberspace, so anonymity is quite feasible.
Is like anybody can be a paparazzi. And like everything it can be used for good or bad, to show violence of police officers towards a prisoner, or a murder, and act of heroism, etc. or it can be used as a weapon towards somebody you dislike (like a former girlfriend/boyfriend, boss,friend, wife, husband, lover, etc) with the intention of hurting them for selfish reasons.

I looked it up about posting on youtube without asking the person in the video for permission. Unless private information, names or anything are revealed, you cannot get sued. The person can have youtube take the video down and the person who posted will have their account deleted if the video violates privacy by revealing personal information. So long as no sexual implications are made in the video, there is nothing there to sue over.

Youtube will most likely take it down if the person in the clip asks for it. The problem is more if you post pics or videos on a private website and don't take them down if you are asked to do so. That's when you can get sued.

Here you go! There's your reality! Of course, most people won't mind, but trust me, I've seen the opposite happen!

A friend of mine is a amateur photographer, and he took pictures of another friend of mine (she is from India) wearing her Sari. Her husband was right there and consented to it, they both got the photos.

Then, the photographer put the pics on his website for advertisement reasons. Her husband threw a hissy fit about it, and he told him to take the photos off the net or he would sue him. The photographer had to take the pics down because he had not had her sign a model release. And they were just harmless photos, nothing sexual involved.

If someone is serious about you taking the photos or clips off the net - you better take them off, because they will win if it actually goes to court, and you can never say when someone is determined enough to actually pay that money for the lawyer, because, guess what! - in the end YOU will pay it!

If a producer knows what they're doing, the release would grant them the right to use the videos/pictures at their discretion to promote the site. They should know the clips will be posted and sold on fetish/tickle related sites. That said, I've had models who were unhappy about seeing their clips on youtube, and I had them deleted.

Are you saying that the friend in question is in a tickling video and is not aware of it? I'm confused by your statement.

If this is true, then I don't know why you would worry about getting the producer in trouble because, quite frankly, that's sort of illegal (I think). But I am assuming, by your comment, that the person did not sign a waiver and is unaware that they're in the thing.

Also, I'm unsure if by appeared you mean was directly involved with the video, or just happened to walk by in the background?
