Hi all....Today I lost my job because of 6 unscheduled absences all due to a car accident I was in in June... as most of you know I have been contending with compression fractures in my spine all summer... I had one more week til my back procedure... and I got fired today... one more week and I could have taken a leave of absence with pay......... I am soooo upset... the head of the hospital didn't even look me in the eye... what bullshit... thanks for letting me vent !!!!!!!!!!!!!!!!!!!!!!!😕

I dont understand how they can fire you when you are physically unable to work..
If a physician certifies that you cant do the job and they term you, then you certainly have a legal case against them...
 
Sounds like a load of bull shit to me. Talk to someone about this and file a grievance against your employer. Sounds like they fired you to avoid paying the medical leave!
 
You poor thing! I hope everything works out okay for you! That is absolutely terrible what they are doing to you.

I am very sorry to hear this Iris. What they did to you was wrong. I agree with venray I think you might have a legal case against them.

Awwwwwwww Iris I am sooo very sorry to hear that the hospital let you go friend, that is absolutely horrible. I am really sorry to hear that you lost your job. I feel so bad, felt terrible when I read this. That really sucks big time friend. I am truly very sorry to hear that you are in chronic pain friend, that is horrible-really sad to hear.

I hope things get better for you. I hope things go smooth for you in future. I want you to know that you are in my thoughts, in my heart, and going to be in my prayers. Just know friend that I am here for you and if you need someone to listen and be here for you-and if you need someone to talk to I will be here for you. Hugs to you. May God be with you and wrap his love around you.

Am also very sorry to hear this -- and my impression was the same regarding the basis for a legal suit -- I don't know anything about the laws in Georgia,

but if there are lawyers in your area who give free consultations,
I'd double check to be sure you have no other options.
Your totally unethical former employer is simply disgusting.

Waiting 2 months to sack you for something most likely out of your control
--- alone, is likely proof the claim is bogus. :disgust:

Especially if you haven't called in absent since, and don't normally call in that frequently ---
The record of your hours worked should back you up.

And especially if/when you can probably provide paperwork proving the accident in June caused your inability to attend work the 6 days in question (way back then...)
--- a police report,
--- insurance documents with dates from your insurance company
--- and/or from the body shop where the car/s involved were fixed --- ?

I don't see how an unjust firing of this sort can be legal, and if it is
those laws need to be updated from the 14th Century. :rules:

Sometimes merely threatening
a lawsuit upon all the above,
especially if you have a good attendance record & when there is nothing more the sh*ts can do to you, may be enough as well.

Easier to say this than to do it, putting yourself on the air and revealing your personal difficulties, but if there is a local public television station, I'd say this abuse is newsworthy. :sowrong:

Either that or a letter to the local newspaper's editor -- Again, perhaps publicity will only make you more miserable, but that is another option.

I know how it feels to be a victim of an "at will" state! It sucks, but you may be entitled to rights you don't know exist by being literally too sick to work.

Find the biggest ambulance chasing lawyer in your state and sit for the appointment. You might be amazed what your rights really are. Whatever you do, don't just sit there...........do something!!!:Grrr::ignite::ranty:
 
You should look up Family Medical Leave Assistance or FMLA and contact a lawyer, you have rights and if the lawyer can prove they fired you because you were sick then you should have rights AND if your employer didn't inform you of your FMLA, you can go after them for that too.

Call a lawyer and mention FMLA... Good luck Lawyer up!
 
I'm so sorry that your problems have reached another notch Iris.

Without wanting to turn this into a political thread, but had there not been a change of government in Australia last year, we'd have been heading towards an industrial relations system where similar things can happen.

The situation seems ridiculous to me - but I'm no attorney. Good luck with it.

He's right, you may be able to go after them through federal laws.
 
I have to add to the chorus, just from what you've said, it sounds like they fired you before having to give you the leave time and potential recovery time, too. See if you have any legal options, and follow through if you can. You deserve a lot better, and maybe now we can find you a new job, like tickle tester or something. 😉
 
Actually, the Right to Work laws mean far less than employers would like us to think. They beat us over the heads with this and other dubious legal concepts so that we surrender without a fight. Document all that happened and consult a lawyer...If for instance you have invoked FMLA during this time...well, God help them because you will WIN!!! Good luck!

I wanted to wish you good luck, and give you some sympathy. We all need that occasionally. I'm unhappy to hear of your situation, and I hope things improve for you.
 
Well I think that was really nice and sweet and great of you to share your condolences on her losing her job and being here for her Helena; even if you not sure what legal advice you could share with her to help her fight back from a legal stand point. But thanks for sharing that Helena.
You also are a great person with a great big heart.
Great to see still many wonderful terrific people here on the forum; that when tears and hurts come-they rise to the plate, so thanks, you and Iris and many other great people make the forum a beautiful fun terrific place to be sooo thanks...

i agree with what many said about seeking legal action. right to work or not, if you have documented proof of being unable to work due to an illness or accident, and you are let go, you can very well take them to court. you may not get much, but it could help with the bills, at least. if i were in your position, i'd be more than happy to stick those assholes with the therapy/surgery bills.

That really sucks. Even if it is a 'Right to Work' state, they still shouldn't be able to fire you for not being able to work.
