That's the problem with the wording of the law regarding sexual assault in Minnesota. If you google it--actually, here's a link:

The wording of all four degrees of sexual assault imply some form of sexual contact or penetration between the perpetrator and the victim. The way the law is worded requires direct contact between the two. Unfortunately, his spunking in her coffee when she's not present doesn't qualify. If she had an attorney, he or she did her a disservice by trying to go this route. I think the guy should have been charged, but with a different crime. I don't know the specific crime that I would charge him with, but based on the circumstances, I doubt he could be charged with anything beyond a misdemeanor. Hopefully the state will take this case into consideration, and modify the law.
