I was wondering if you have ever been sued, or had charges pressed against you (angry friends ect) by a Lee that wasn't happy with being tickled. What measures do you take to protect yourselves from these things? I know this is somewhat personal but I have considered dipping my toes in tickling video clips, and want to know the chances of having legal problems. Thanks for any input.

You have the model sign a contract upfront that says exactly what's going to happen, what will be done, what will be released. It also never hurts to have a witness present, for producer and model alike!
 
You should ask the bigger question about what are all the legal issues surrounding making clips....okay, I'll ask it for you:

Hey producers, what are ALL the legal/tax issues involved with making tickling clips and selling them on clips4sale?

(You may also want to rename the thread "Hey producers, ever got sued?!" or something more specific. I, and I've noticed others, usually ignore generalized titles.)

I know they're all worried about competition, so may ignore this thread, if they even notice it in the first place.....but folks, does anyone else notice the field is drying up out there?! Yeah, yeah, yeah, comparing it to the old days of JUST Tickler in Black, who as the leader, Paradise Vision, Magic Touch, ANA, that was about it, ....to today, yeah, there are more companies, but we have a lot more members!

AND:
- many of today's companies are producing less and less stuff (The 4 Czech sites used to update almost daily, they've really slacked off, for example.)

- many of today's companies are drifting into more porn than tickling, the lament of several threads recently...so they are almost spiritually leaving the forum and drifting over to other sex forums. Now, if they're making more money by doing that, more power to them...but that opens up more actual tickling video competition for eager start ups.
-several sites have closed down, or are almost there - it was just mentioned that Nylon Tickling, used to be my favorite site, is shut down. Kaylee from TMJ had her own site - it's shut down. Tickle Haven, another favorite of mine, has really slacked off on clips. Someone just mentioned LOL videos.....nothing. Viviana released ONE clip in about the last year, and has been silent ever since. TickleTown hasn't released anything in months, but promises something on the horizon.....

(I don't count the crappy sites that don't even bother visiting the forum, I hate it when producers even mention them as competition. The tickling....if it's even tickling, is so atrocious it's not worth mentioning. You sure won't get a laughing model. No one talks about them, so I assume few here are customers, or even aware of them. They offer no previews, probably don't even know about the forum. I've actually bought one or two clips from non-forum companies to see what they're like - goddamn, they suck!! The worst clip posted here would be a masterpiece on an off-forum company.....)

The contract cannot be misleading. Like, the way it's worded, ect. If the contract is brought up in court if a model tries to sue, the wording has to be perfectly clear that she was going to be tied up (including describing how she'd be tied up), that she would be tickled (must include duration of time, the places she'd be tickled, a safe word or way out, ect). Most important of all, it must express that she is allowed to get out of the contract at any time and cannot be forced against her will to continue to endure the tickling if it's more than she can handle.

I understand this, but some clips out there the Lee is begging for the tickling to stop, and it doesnt. I mean how much does the contract really protect the producer. Maybe the safeword isn't used, the Lee could lie in court saying she couldn't remember. This is what I'm curious about.

Most of that "begging" is faking. Or even if it's not, she's begging for it to stop and not using the safeword to actually make it stop, which means that she can't argue he didn't listen to her. If she screemed "I forgot the safeword, you really need to stop!" and the tickler kept going, that's a different story. If the girl was in any real harm or was under extreme duress, the producer has to stop the clip from being made. When it comes to contracts, they are not binding if one person is placed under extreme emotional or physical duress, even if they were aware of it prior to agreement to the contract. Forcing a ticklee to endure more than she can take against her will is considered crossing the line and breaching the contractual agreement.


From what it sounds like overall, I get the impression that a lot of the girls really enjoy doing the shoots. Now, that's not to say that there are those who wish they didn't agree to it. However, they are getting paid so unless they feel like they've been emotionally scarred by the event I can't see a girl trying to sue a tickle producer. She would really have to prove that she suffered, and I can't see how she could prove that without witnesses. Video evidence would have to be extremely convincing that she was genuinely begging and not faking, and if the contract does a good enough job explaining the tickling aspect, she wouldn't have much of a case.
