Wow ... what kind of fucked up people are running around in /that/ person's past?
I get sometimes a tickle will get completely out of hand and it's a bad, entirely nonconsensual experience, but until we as a society decide we need tickle shelters and hotlines for the brutally tickled and people start doing time for it, I don't really see that anyone's out much of anything beyond some loss of composure in public and possibly bladder control. Not saying it can't be traumatic, but if that's what you're going to go with you should at least be able to get them on assault, which is at least criminal.
I suggest this little philosophy is overstating things somewhat.
