"ticklevids" and Copying Out-of-Print Videos

A month or two back, I posted a thread asking for people's input about copying "out-of-print" videos for resale, and I agreed with everyone's assesment that it's still a "no-no."

Interestingly, our friend "ticklevids" replied that some of the old, "defunct" video producers may, in fact, only be "dormant." He pointed out that some (he cited TJ Productions) may even sell their rights to other producers (again citing TJ's selling the rights to "No More" and "Her Turn" to SilverCherry).

This brings up an intriguing question, for those "dormant" producers who still may be lurking about here:

What if an individual (say, me) was still desperately searching for one of these old videos (say, TJ's "Safeword?") and wanted to propose this arrangement: TJ would sell me, short term, the rights to this one video, for an amount, let's say, equal to its original purchase price, and that I agreed, upon receiving that video, to immediately return those rights to the original producer (perhaps even signing an agreement to do so, before actually reciving the video).

Wouldn't this bypass any concerns the original producer had about remaining "dormant," while still allowing one to have-- what I've read is-- a truly great video?

I know I've posted several times over the months, looking for "Safeword?", so I aplogize if people are becoming annoyed with my persistance. But, hey, isn't the key to advertising "frequency, frequency, frequency?!!!" 🙂

my take

if a video company can't or won't releasean old video, then i see nothing wrong with making a copy and giving it to another person/fan.
but to sell copies of anothers work would be wrong. if i have a video that some one wants, that is unavaliable, but i don't wish to part with it, then i think i could copy it, and only ask for the cost of a tape, and postage. we're talking of about $5 here. but to start making dozens of copies, and selling them at $20 each would constitute a crime in my book.
