I have a question regarding the forum's policy about trading viseos from companies that no longer exist.

First, let me say, I full agree with everything that's been written here many times, regarding the importance of supporting Jeff, Kathy and all the others who provide us with with the wonderful videos that they do. I have, and will, continue to buy dirctly from them.

However, when a company no longer exists, (TJ Productions, Solefully Yours, etc.) is it OK to seek video trades, or seek to buy/sell these videos?

How about videos that have been "retired" by their respective companies? Are there alternatives if someone wants to acquire a video that has been retired. I'd like to here all viewpoints, but especially the video producers themselves.

I'm new here and want to stay within the letter and spirit of the rules. Thanks

Good Question....

While I have no idea what the laws or the ethics have to say about this idea, I'd have to say that I can find no moral objection to supplying something to someone that they can no longer get from the legitimate source.

The problem I can see is that copyrights last for a certain amount of time, and that time might live on even after the comany does not.... then if that company sues the pants off of you, they might have money to go back into business!!

I also would imagine that it would make a difference if you were selling a copy of a video that is from an extinct company, or simply giving a copy away, perhaps to a friend or something.... I would assume that the selling would be frowned upon, because you are profiting from someone else's work.

whats the verdict?? any lawyers? moderators? acrobats? circus midgets?

I can only speak for our company, TC. No, we do not allow or condone selling or duping/trading our videos that we have "retired" in the past. We have simply retired them on VHS-tape format. We still own the copyrights to them and will be putting them on CD-rom in the future. So please don't let the word "retired" make you think its a 'free for all' to buy, sell and trade our copyrighted material amongst yourselves.🙂
Thank you,
Sincerely,

copyright and the holding of it

Actually, you're breaking the law when duplication Solefully Yours' work. Worked wit' them, long ago, and know that they had copyright on all work. Just because they're not in business actively doesn't mean that Pam doesn't own the rights to the work, and it's not difficult to prosecute.

Simpler, though, is that it's not difficult to get a body's account killed. No ISP wants to deal with copywrite infringment.

Suppose someone bigger buys SY's stock, for instance. That vendor can sue, as the lawful distributor of the SY stock, for instance. Many of the former video companies have sold stock to competitors.

Besides, though, SY was a family biz, and the lady that ran it was really cool. Her now-ex-husband wasn't so good, as damned near everyone experienced in the USENET tickling group of the time, but he's also not the holder of that company. She is.

I hold distribution rights to those videos, and had negotiated distribution through another business, as a favor to Pam. Personally, I don't dig the idea of chasing around my peers, here. Then again, I also don't like the notion of Pam losing any more than the divorce cost her. The lady's suffered enough.

Just so we're clear, I hold rights to Solefully Yours at present. If you're distributing those tapes, you're ripping me off, and Pam. Not nice.

How would you know? You don't, at present. If you don't see me point out who's legally distributing them, though, it's a good bet that they're not being sold by or for Pam, or her kids. Again, not nice.

Be nice t'the lady. Wait until I can find a distributor for those videos, and buy them from that distributor.

Solefully yours vids

Hey DVNC were those SY vids any good? Just when I was gonna buy some they went out of bussiness I know they made a lot of foot tickling vids Just curious I hope you find a way to start selling them soon

Well, y'gotta figure I have a biased opinion, but in all honesty, I liked a lot of their tickling videos. They were a mom-and-pop shop, very honest and straight forward, with Pam tickling the various models, or the models tickling one another, often with Pam ultimately helping.

They also did a boatload of foot fetish videos. I understand those were favored, too.

Most of their videos were based on customer requests. Some of their vids actually had Pam on the phone, doing a custom video, and that video showed so well that they'd sell it.

My personal favs included the ones Pam did where she let the models take revenge. Nothing more enthusiastic than a tickling model tickling the boss. Those young ladies managed to find every ticklish spot on the woman. Fine work indeed.

I hope I find such a means, too, gen.zod. Not only did I find amusement in what are now considered an old fashioned style of video shoot (they WERE mom-and-pop, after all, and very low budget), but I like the notion that her kids benefit from her old work.

Another $0.02,

Thanks to all.

DVNC, if there ever is a legal distribution channel, please let me know. Also, if anyone knows a legal way to buy TJ Production videos, please let me know.

Thanks!

Why on earth would you want to? I have seen Tommy's work and knew him personally, once upon a time. I wouldn't watch another one, if He paid Me.

Jen
Sorry. Bad feelings still lingering on that topic.

Sorry for whatever happened, Jen.

I don't know the person who made them, or anything about him, and my interest has nothing to do with the proprieter. It's just that my all-time favorite video, "Safeword", just happens to be made by them. If there were a legal and ethical way of buying a clean copy, or other ones with the same ticklee, then I wanted to pursue that.

NYCity, I wouldn't count on a legal way t'buy TJ vids. They were the most "secure" video company around. You had to sign a legal agreement not to redistribute the purchased video in order to get them.

That they seem to have offended NJJen is just more motivation to forget 'em.

My perspective on it,

I have a quandry of a different sort....
I'm trying to find some old video ( I mean OLD - like from the early 80s, stuff on Beta and early VHS ) that simply, for the most part cannot be found. Stuff from companies lIke Tao, Bon-Vue, Nu-Vue, etc.... These were far from being the best videos, but call it a warped sense of nostalgia, I guess, I'd like to see some of these again, at least clean copies. Now, in the cases of these videos, consider, A> I AM willing to pay the company ( or holder) for the videos... for a resoanble price.... but B> not only is the company out of business, but any way to follow up with said companies have pretty much dissapeared, it's been so long. "Waiting " for this stuff to come out on DVD , well, it isn't gonna happen, reality being what it is. It took 30 years for the Marx Brother's ANIMAL CRACKERS to ge through all the legal wrangling before it was rereleased... I don't think a home grown, fly-by-night video comapny from 1982 is going to be any easier to negotiate with...so, what is one's chioce BUT to trade with other collectors? (I'm not talking about companies like Solefully Yours, T.J., Bloodstone - and what happened to them???- et al, I'm just talking about the truly obscure outfits from literaaly 15+ years ago which themselves may not been completely above board with the laws, reguarding taxes, ID-ing their models, etc...) Working in the video field myself, I understand the value and need of the copyright, but at the same time it's so cool something wonderful and amazing goes public domain that hasn't been seen in years and was really unfair to have been hidden from the public for so long... If only there was some in-between for us tickle-philes that know what we like, but at the same time aren't looking to start trouble. Sigh...... weeping.. weeping....
