.38/.380 are more likely to pass through without damaging the tissues too severely, since they are jacketed but usually sub-sonical - so shock doesn't reverberate to close organs.

well since it passed through her shoulder/neck region which might haven't been a thick area, so it's possible it might have been a .22 though there are rare as sidearms. but a .32, .38, or 9mm sounds more logical. but thank god it wasn't a .50 caliber or she'd be carrying her head around in her hands.
but a good and just punishment for this idiot, would have a person with bad parkinson's disease shoot a gun preferably a dirty harry .44 cal. "hand cannon" at him from 10-20 feet away. talk about making him piss his shorts.
