I don't think it's prostitution, but I know some US states have laws against it in one way or another. I don't know exactly which ones.
If the person you ask is pissed about it, I guess it could fall under sexual harrassment though although I really doubt it would make it to court. Depends on the circumstances. If you ask a colleague, I think that would certainly have the potential to get you in trouble.
If there is no sexual contact (ie no bathing suit area touching) then you are clear in most places. But some areas have odd laws left over from the last century, that prohibit the filming of anything with an intent to arouse. So you can get in trouble if you have a DA out to make a name.
The last time I took sexual harassment training, it was indicated that you were allowed to ask someone for a date once, and once only. If they said no, and you asked again, then it was harassment.
However, I would imagine that asking someone to star in a porn video would be sliiightly less well-received. Could you be sued for one incident? Probably not, but I wouldn't test my luck. Not at the office.
Random folks on the street? I doubt you'll be sued just for asking. But, if you're really worried about the legalities of making videos in your area, ask a lawyer.
