So my brother had been working at Cash Wise for nearly a year and a half. He enjoyed his job and worked very hard there.

Recently he was fired from Cash Wise. Why? Because he had bought some food from the deli area and went back for a pop refill. He thought there was free refills, but that wasn't true. They used to have free refills but they changed that rule and my brother didn't know.

So instead of simply having him pay for the refill, they first wrote him and suspended him. Then they turned around and fired him for stealing, which they're not supposed to do since it's double jeopardy.

Now my brother received a letter in the mail that Cash Wise is pressing charges against for theft and damages. :facepalm:

It's a stupid fountain pop refill. It's not like he stole money out of the cash register or something.

I'm so pissed off at them. :banghead: They've just lost my mom's business and mine, and I'm working on getting everyone I know to stop shopping there. They're turning a small thing into a big thing, and they went about it all wrong. :sowrong:
 
Did he get along with the people he worked with?Sometimes if someone has a grudge they will exploit any little mistake out of spite.Co-workers can be malicious like that.

Either way I hope everything works out in the long run.

He got along with most of his coworkers but the guy who wrote him up then got him fired had been causing him problems. I'm sure the guy was looking for any opportunity to get him in trouble. :sowrong:
 
Ah, idiotic, pedantic corporate culture at it's best. Instead of dealing with the situation using common sense they go mental and throw their toys out of the pram.

It'd make far more sense to say 'oi, don't do that again' and keep him on than it would be to recruit a completely green member of staff and train them up to do his job. A drink re-fill costs pennies.

Thats messed up hun. I am so sorry for your brother nemesis. The best thing you can do is get the word out on how this company behaves and treats its employees. The loss of business especially in tough economic times should teach them the lesson they apparently need to learn.
 
Contact the local news station...the LOVE to give bad publicity to idiots like that!

They damn well should throw it out. It's absurd waste of time cases like this that clog up the legal system. What a moron this guy is. I'm sorry for what your brother has had to endure. It's so beyond ridiculous.
 
This does seem like a stupid situation. Honestly I would do what Venray said but at the same time research those charges. There really can't be much ground for them as a refill probably isn't more than a dollar. No harm done, no economic lose what so ever, and I highly doubt anyone has suffer mental trauma besides your brother. I can't really see this being taken seriously by any court. I also agree with counter suing over slander. That may just scare enough to have them back off because it seems like your brother has a far better standing. Throw in some hostile work enviroment and you are golden. Best of luck to him.

My brother is going to get a copy of the police report so he knows what he's up against, and he will be assigned a public defender since he can't afford a lawyer. I don't know about counter suing them since he can't afford to hire a lawyer. He's only 19 and is getting screwed over something incredibly stupid.
 
What utter,unbelievable, bull shit. I wonder how far up the food chain this got. If i were a districit or regional manager i would rip the moron who did this a new one.

Unfortunately, my state is a "right to work". Read: they can fire you whenever they want without telling you why. I submit to you the real life story from my college life as a checkout girl. Courtesy clerk (bagger) Elaine was cute as a button, not a mean or dishonest bone in ther body but dumber than a box of hair. ONE year after hire, I STILL had to remind her not to toss the Zest in with the same bag as the saltines. Asst clerk Bobby (who loathed her) caught her nibbling on her candy bar on her break standing in line. He fired her for cheating on the spot. Nothing happened to him and she filed grievance with union which was tossed out. They claim her claim she intended to pay for the candybar wasn't good enough. Technically, she ate food she hadn't paid for, in their mind constituted stealing. I'm not saying it's right but it's a true story.

I hope this doesn't come out the wrong way, because I'm really not trying to be a bitch, but do you know, for a fact, that that's what happened? I can't imagine any company being stupid enough to spend the money it's going to cost to sue your brother for a soda refill, especially considering how ridiculously cheap that soda actually is in terms of cost to the company.

Is there a chance that your brother got caught doing something else, stealing something else, and he's just using this soda story to cover his tracks so you guys don't find out what really happened?

As far as the countersuit, I'm not a lawyer, so I could be wrong, but I believe that slander is when someone says something about you that's not true. If he did indeed "steal" the soda refill, and they're saying he stole the soda refill, that's not slander. If they're saying he punched a kid in the face to get to the soda, then maybe that's slander, but saying he did something he did, even if by accident, isn't slander, as far as I know.

I can't see my brother continuing to tell this story now that he's being sued if it's not true.

I think it would be relatively easy for my parents and anyone else to find out the truth of what he did.

So Cash Wise decides to fire your brother and press charges all over a $2.00 or less soda? I find that hard to believe that they will spend money to take him to court over this.

During the time your brother worked there, did he ever get into trouble or anything?

None that I know of. Before he worked at Cash Wise, he worked at the same convenience store that I do. He was always a hard worker and never caused any problems. He enjoyed his job and he did it well.

If he did anything more, I would think it would be listed in the charges.
 
THIS IS A CASE FOR THE LABOR RELATIONS BOARD!

I cannot believe that this case has gone this far. In my hometown there is a Law School where there are plenty of apprentice lawyers who would jump on a case like this. If he counter sues they will probably settle this matter because it will become to costly for them to pursue with all of the bad publicity that they will receive.

I imagine the court documents will say he is being charged with theft. That leaves alot to the imagination. He doesn't have much choice than to tell you guys SOMETHING, because if he's going to court you're likely going to find out. This could a preemptive move to try and limit the questions you ask when he has to actually go to court. I don't know - just doesn't seem right.
