Indeed. A proper model release should state that the model acknowledge that she is not under the influence of alcohol or drugs. If a producer suspects a model is, at least in NY it is illegal to film that model.

I find this thread kind of ridiculous.

You'd have to be a pretty sick fuck - considering the reasons many young women turn to pornography in the first place - to try and sue her or in any way force reimbursement for setting up a few cameras and lights in your home, but to carry on regardless, that is just inhumane.

Believe it or not, I actually find the idea of attempting to sue her or ruin her name to be more malicious and inhumane than tickling her against her will. Not that I'm condoning the latter, nor will I deny that it's probably the non-con fantasy intriguing me. But honestly, if a girl was tickled despite attempting to back out at the last second, I'd probably buy that, ethic aside. But if she were let go and the producer attempted to sue or take legal action, I'd never buy from that producer again. Even having the model reimburse him for the cost of the set up would leave a bad taste in my mouth.

I'm weird like that.

Trolling is something that will get you banned here. You opened a discussion, and when several professionals made comments that reflect their experience answered you reply with an insult.

None of the producers made a statement that they were better then anyone. They were simply adding knowledge to the discussion. Knowledge that can only come from running a production company for a good bit in a difficult and highly competitive field.

This thread is a pretty simple one to answer, which I did far above.

A contract signed by a model is not a document of intent. It's an agreement for service over time within parameters. If a model chooses to not follow thru on a shoot due to nerves or second thoughts, yes, a producers time has been wasted, and that means some cash has been lost. But the contract is not a document that gives them free reign to do whatever was stated to a model in discussion no matter when said model says. Its simply a contract that allows for pay, and distribution rights.

Same here. Oh, I know I don't do a very good job of it, as I lack the necessary training, skill and equipment. But at least I try, and a fair amount of time goes into adjusting the lighting, color balance, camcorder angles, etc. I actually wish I didn't feel the need to do all that, because it tends to make shoots take longer than I'm comfortable with. Shoots would be a lot simpler and less stressful if I just didn't give a damn.

I'm not sure I understand what the controversy is over this type of situation. I mean, I've no experience actually making a fetish video or working with models or using contracts, but if it were me I would just let her go and cut my losses. No amount of lost time and effort will compare to the lawsuit and possible jail time that I would be facing if I chose not to.

As far as "smearing her name", again, that is also something I wouldn't do. Mostly because it's childish and petty, but also because it more than likely would backfire on my begrudging ass and prevent any models from working with me in the near future.

Alright, if we’re actually being serious and legal, due to the 13th Amendment (prohibits involuntary servitude), you really cannot make someone provide services if they refuse, even if they once agreed to do so. Yes, in theory, you could sue them for the damages due to your reliance on their promise to do the video, but I assure you that the legal fees to do so would exceed the damages you would recover.

But if we are less serious, and have some fun with this (i.e, depart from reality), shouldn’t we have the producer, who has the person restrained, say, “okay, if you changed your mind, I’ll let you go, but first just let me give you a gentle poke. Do you still want to go? Ok, just one more! [Model giggles, changes her mind, and everyone has a blast.]
